Progressing Your Personal Injury Claim During the Pandemic

One of the most important things to do in a personal injury case is to keep the case moving forward.   With the emergence of Covid-19 this has become even more difficult.  In the approximately three months since Covid-19 there has not been a civil jury trial in Pima County.  It is difficult to imagine a civil jury trial taking place before the start of next year.  How does an injured keep their case on track?

Telemedicine

Medical records are the crucial documentary evidence personal injury attorneys use in proving a case. Getting the recommended medical care is critical to illustrating to the jury the nature of someone’s injuries.

During the pandemic, it has not been easy to get treatment, office visits have been postponed or cancelled and in Arizona non-elective surgeries were also shut down. In addition, some clients do not feel comfortable going to the doctor for fear of exposing themselves to COVID-19. These are legitimate concerns. Undoubtedly, insurance companies will use this against you to show a “gap” in treatment – and will argue that injuries are either not as severe of plaintiffs are overtreating.

One way around the reduced medical access problem, is telemedicine.  Many doctors, including specialists, are treating patients remotely using either FaceTime or Zoom.

It is important to get the care you need and keep the medical records consistent and up to date.  If you are having trouble accessing care, it is important you tell your medical providers of your difficulty, additionally an attorney may be able to assist.
